Lumiere Membership Program Terms & Conditions

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE LUMIERE CAFÉ MEMBERSHIP PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT ACCESS OR PARTICIPATE IN THE LUMIERE CAFÉ MEMBERSHIP PROGRAM.

We reserve the right, in our sole and absolute discretion, to modify all or any portion of these Terms at any time without incurring any liability or obligation whatsoever to you or any other person or entity. You agree that we may provide notices, disclosures and amendments to these Terms of Use, and other information relating to the Lumiere Cafe Membership program by electronic means, including posting such information and materials online at https://lumierecafe.com/

These Terms of Use apply to your access to, and participation in, the Lumiere Cafe Membership program in Canada ("Lumiere Café Membership"), which is operated by Lumiere Café Limited or its respective subsidiaries, licensees and affiliated companies (collectively, "Lumiere ").

IF YOU DO NOT ACCEPT AND AGREE TO BE LEGALLY BOUND BY AND COMPLY WITH THE TERMS, YOU ARE NOT PERMITTED TO PARTICIPATE IN THE PROGRAM.

The Program is valid in Canada only.

Lumiere Cafe Membership is intended for personal use only. Commercial use is prohibited. Lumiere Cafe Membership is not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and the age of majority in your jurisdiction of residence, you may access and participate in Lumiere Cafe Membership only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.

Please read the Privacy Statement carefully to understand how Lumiere collects, uses and discloses information about customers, how to update or change your personal information, and how we communicate with you.

About Lumiere Cafe Membership

Lumiere Cafe Membership is our way of saying thanks to you, our customers, for being loyal Lumiere patrons. The Lumiere Cafe Membership Program is a loyalty program which is operated by Lumiere and is open only to legal residents of Canada. The membership system will have various tiers to better reward our customer base for supporting our products and services. It allows participants who register in accordance with these Terms to collect points, which can be redeemed for products and amenities that our stores provide. The rate in which points are earned, as well as access to the various reward options will differ across the tiers that will be outlined below.

Joining Lumiere Cafe Membership

Before you may participate in the Program, you must obtain a digital card by downloading the Lumiere mobile app to your Android™ or iPhone® device.

The Lumiere Cafe Membership registration process may require that you provide the following information: username, password, email address, physical address, telephone number, credit card number and card security code, birthday, name, and marketing preferences.

Lumiere Cafe Membership is offered for personal use only and is not for commercial or other business use.

Other Important Information You Should Know

There are no participation or membership fees associated with Lumiere Cafe Membership. Points accrued in connection with Lumiere Cafe Membership are promotional, have no cash value, and cannot be redeemed for cash. In addition, your redemption of Points accrued in connection with Lumiere Cafe Membership cannot be combined with any other offers or discounts that are applicable to the Rewards for which you are redeeming such Points , unless otherwise expressly indicated by Lumiere.

Your Points, Rewards, Lumiere Cards registered to your Lumiere Cafe Membership account, and your Lumiere Cafe Membership account are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose.

Lumiere reserves the right to suspend any Lumiere Card registered to your Lumiere Cafe Membership account and/or terminate your Lumiere Cafe Membership account and/or your participation in Lumiere Cafe Membership if Lumiere determines that you have violated these Terms of Use or that the use of your Lumiere Cafe Membership account is unauthorized, deceptive, fraudulent or otherwise unlawful. Lumiere may suspend, cancel or combine Lumiere Cafe Membership accounts that appear to be duplicative. In the event that your participation in Lumiere Cafe Membership is terminated, all accrued Points in your Lumiere Cafe Membership account are void.

Lumiere reserves the right to change, modify, discontinue or cancel Lumiere Cafe Membership or any part of Lumiere Cafe Membership at any time and in its sole discretion, without notice to you.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL ASPECTS OF THE PROGRAM ARE PROVIDED "AS IS" WITHOUT ANY CONDITION, REPRESENTATION OR WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

Severability

If any provision or part of a provision of these Terms of Use is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.
