PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE LUMIERE REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT ACCESS OR PARTICIPATE IN THE LUMIERE REWARDS PROGRAM.
You agree that we may provide notices, disclosures and amendments to these Terms of Use, and other information relating to the LumiereRewards program by electronic means, including posting such information and materials online at https://lumierecafe.com/.
These Terms of Use apply to your access to, and participation in, the Lumiere Rewards program in Canada ("Lumiere Rewards"), which is operated by Lumiere Coffee Canada, Inc. or its respective subsidiaries, licensees and affiliated companies (collectively, "Lumiere "). These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with Lumiere for other products or services, such as Lumiere Cards.
For Quebec Residents: We will provide you with notice of the proposed amendment via in-app message or email (depending on your communication preferences). The notice will contain a description of the amendments and a description of your cancellation rights under this clause. If you disagree with any amendments, you may terminate these Terms of Use by sending us a notice to that effect at any time in the 30-day period prior to the amendments coming into effect. If the amendment increases your obligations under these Terms of Use, or decreases our obligations under these Terms of Use, then you can also cancel in the 30 days after the amendments take effect. In either case, there will be no cost or penalty for canceling. For greater clarity, your continued participation in Lumiere Rewards following any applicable notice period confirms your acceptance of any such changes.
For Residents of All Other Provinces: Lumiere reserves the right to change or modify these Terms of Use or any policy, FAQ, or guideline pertaining to Lumiere Rewards, in whole or in part, at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to https://lumierecafe.com/ and you waive any right you may have to receive specific notice of such changes or modifications. Your continued access to or participation in Lumiere Rewards following any such changes or modifications confirms your acceptance of these Terms of Use and such changes or modifications; therefore, you should review these Terms of Use and the policies, FAQs and guidelines pertaining to Lumiere Rewards frequently to understand the terms and conditions that apply to your access to and participation in Lumiere Rewards. If you do not agree to these Terms of Use, you must stop accessing and participating in Lumiere Rewards.
Lumiere Rewards is intended for personal use only. Commercial use is prohibited. Lumiere Rewards is not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and the age of majority in your jurisdiction of residence, you may access and participate in Lumiere Rewards only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.
Please read the Privacy Statement carefully to understand how Lumiere collects, uses and discloses information about customers, how to update or change your personal information, and how we communicate with you.
About Lumiere Rewards
Lumiere Rewards is one way in which Lumiere endeavors to reward and thank loyal customers for patronizing our business and purchasing Lumiere products. Lumiere Rewards members are able to earn and accumulate "Points" that can be redeemed for Lumiere Rewards benefits ("Rewards") at participating Lumiere stores and are eligible to receive certain additional benefits. Unfortunately, not all Lumiere stores have the ability to award Points or redeem Points for Rewards at this time.
Joining Lumiere Rewards
To be eligible to join Lumiere Rewards in accordance with these Terms of Use, you must register a physical address in Canada at the time you join Lumiere Rewards.
There are four (4) ways to join Lumiere Rewards and begin accumulating points:
Download the Lumiere mobile app to your Android™ or iPhone® device. Follow the prompts to create a Lumiere Rewards account and register a digital Lumiere Card.
Purchase a qualifying Lumiere product from a participating grocery retailer and submit a photo of your valid receipt confirming your purchase of qualifying products at Lumiere retail store. Follow the applicable prompts to create a Lumiere Rewards account. Note that such creation will automatically register a digital Lumiere Card to your Lumiere Rewards account.
Join Lumiere Rewards through a special promotion, membership or other program that may be offered by Lumiere and/or our business partners or affiliates. There may be additional terms and conditions applicable to these promotions and programs, so please read them carefully. Note that any creation of a Lumiere Rewards account through a special promotion, membership or other program will automatically register a digital Lumiere Card to your Lumiere Rewards account.
Lumiere Cards and Account Registration
The Lumiere Rewards registration process requires you to add a Lumiere Card to your Lumiere Rewards account. Lumiere Cards may include: physical Lumiere plastic cards that are available for sale from participating Lumiere stores and other retail locations (for example, gift card "malls" or kiosks); digital forms of physical Lumiere plastic cards; and Lumiere Card eGifts that can be purchased at Lumiere Retail Stores. In addition, the Lumiere Rewards registration process may require that you provide the following information: username, password, email address, physical address, telephone number, Lumiere Card number and card security code (CSC), birthday, name, and marketing preferences. All of your Lumiere Cards can be activated and registered for use in Lumiere Rewards, but you may have only one (1) Lumiere Rewards account that is personal to you.
If you change the address associated with your Lumiere Rewards account to one that is not located in Canada, your Lumiere Cards will continue to function, but your Lumiere Rewards account will be deactivated. During such deactivation, you will no longer be able to earn Points or redeem Points for Rewards under your Lumiere Rewards account. Note that previously earned Points in your Lumiere Rewards account may expire as described below.
Earning Points
The Rewards that are available to you through Lumiere Rewards are based on the number of Points that you earn. You can earn Points by making purchases with a Lumiere Card registered to your Lumiere Rewards account at participating Lumiere stores in Canada, the United States, Puerto Rico, the United Kingdom and Ireland.
You will earn Points based on the value of your purchase at the rate of twenty (20) points for each One Canadian Dollar ($1.00) you spend at participating Lumiere stores using a Lumiere Card registered to your Lumiere Rewards account. Note that Points may be earned in fractional amounts depending on the value of your purchase.
Currency Exchange
If the address associated with your Lumiere Rewards account is located in Canada, any qualifying purchase you make using a Lumiere Card registered to your Lumiere Rewards account at participating Lumiere stores in Canada, the United States, Puerto Rico, the United Kingdom or Ireland will earn Points as if the currency were expressed in Canadian Dollars. No currency exchange is applied to the value of your purchase for the purpose of determining how many Points you have earned. For example, if the value of your purchase is One Canadian Dollar or One Pound (United Kingdom), you will earn three (3) points for your purchase in each case.
Additional Methods for Earning Points
Promotional Bonus Points Offers. From time to time, we, or others acting with our permission, may offer you special promotions that offer you additional "Bonus Points." The promotional Bonus Points will be awarded as described in the applicable promotional offer and will be subject to any additional terms set forth in such promotional offers. These promotional Bonus Points may only be available to residents of certain provinces, or they may be offered Canada-wide.
Partnership Programs. Eligible customers may earn Points through participation in programs offered by our business partners. Lumiere does not operate and is not responsible for these programs, which have separate and additional terms and conditions governing how Points may be earned.
Exclusions to Earning Points
You may not earn Points in connection with certain types of beta or promotional programs. In addition, you cannot earn Points on purchases of alcoholic beverages or on Lumiere Cards (such as activations, reloads, transfers, and other card-to-card transactions). Taxes, tips, donations, and fees, including without limitation, shipping and handling fees, gift wrapping fees, delivery fees, and bag fees, also may be excluded and ineligible for Points accrual.
When Points Are Added to Your Lumiere Rewards Account
Generally, Points are automatically added to your Lumiere Rewards account within twenty-four (24) hours of when you earned them. Note that there may be a delay in adding Points earned through receipt verification to your Lumiere Rewards account. Points earned through receipt verification are generally added to your Lumiere Rewards account within 3-5 business days from when you complete the receipt submission at Lumiere retail store.
If you void a purchase made with a Lumiere Card registered to your Lumiere Rewards account, Lumiere will deduct the Points that you earned for that purchase, potentially resulting in a negative Points balance on your Lumiere Rewards account. If you return merchandise, packaged coffee, food or tea that you purchased with a Lumiere Card registered to your Lumiere Rewards account (note: an original receipt or gift receipt is required), your funds will be returned to you on a card with store credit, but Lumiere will not deduct any Points from your Lumiere Rewards account. Cards with store credit may be used in any participating Lumiere stores, but they are not Lumiere Cards. Purchases made with cards with store credit do not accrue Points and cannot be registered or reloaded for additional value.
If you use multiple forms of payment in one transaction, such as cash, credit card or a Lumiere Card that is not registered to your Lumiere Rewards account, you will earn a prorated number of Points based on the eligible purchase amount that was purchased using a Lumiere Card registered to your Lumiere Rewards account.
Points Redemption
As a member of Lumiere Rewards, you are eligible to redeem Points for complimentary Lumiere items at participating Lumiere stores in Canada, the United States, Puerto Rico, the United Kingdom and Ireland. Lumiere Rewards offers different Rewards based on different Points redemption tiers. Note that the Rewards available and Points redemption tiers may vary by country. The Points redemption tiers for redeeming Points at participating Lumiere stores in Canada are as follows:
Points may be redeemed for one (1) of the following beverage modifiers: an added espresso shot, added syrup or sauce (such as mocha sauce), or a dairy alternative option (such as soy beverage, almond beverage, or coconut beverage), valued up to One Canadian Dollar ($1.00 CAD). The beverage modifiers in this redemption tier are only available as a customization to your base beverage order and cannot be redeemed as a standalone beverage.
Points may be redeemed for one (1) of the following items: hot brewed coffee or hot steeped tea OR a bakery item. Bakery items may include cake pops, cookies, croissants, bagels, and loaf cake slices. Iced brewed coffee, Clover brewed coffee, and Lumiere Pourover coffees are excluded from this redemption tier.
Point may be redeemed for one (1) of the following items: any handcrafted beverage (such as a latte or Blenderino® blended beverage), OR any hot breakfast item (such as a breakfast sandwich or oatmeal), OR any packaged snack item (excluding packaged protein boxes). All beverages must be standard menu-sized items.
Points may be redeemed for one (1) packaged salad or lunch sandwich OR one (1) packaged protein box.
Points may be redeemed for one (1) packaged coffee item (such as whole bean coffee) OR a select merchandise item with a value up to Twenty Canadian Dollars ($20.00 CAD) (pre-tax). Packaged coffee and merchandise availability may vary by store location.
Points Redemption May Vary, and Maybe Changed At Any Given Time Without Prior Notice; Participating Lumiere Stores Only
Points may be redeemed for a Lumiere Founder’s Pass, which grants the redeemer one (1) beverage, with a maximum of three (3) modifications, or a total value not exceeding eight (8) Canadian dollars per day free of charge. One day constitutes a time frame from 6:00AM local time to 6:00AM local time the subsequent day. For instance if the redeemer claims a free beverage, their next free beverage would only be claimable the next day after 6:00AM. Founder’s Pass beverages can only be claimed upon production of proper identification; membership cards, phone app QR codes count towards identification. Any store or staff member can refuse a claim based upon the failure to provide proper identification, and further identification (such as government issued identification) can be requested retroactively given any suspicion that the claimant is not the true Pass holder.
Rewards and Points redemption tiers vary by country. Not all Lumiere stores have the ability to honour all Points redemption tiers, and the items available for redemption in each Points redemption tier may vary by participating Lumiere store location. Certain Lumiere stores (such as those in certain grocery and airport locations) may offer only the 200 Point redemption tier. At such locations, and notwithstanding anything to the contrary in these Terms of Use, you will be eligible to redeem 200 Points for one (1) handcrafted beverage OR one (1) food item only.
Other Important Point Redemption Information and Exclusions
Points may be redeemed at participating Lumiere stores and are ineligible to be redeemed for the following items: alcoholic beverages; multi-serve food or beverage items (for example, a tray of pastries or a bulk coffee containers); and items available at Specially Designated Lumiere establishments..
You must present a Lumiere Card registered to your Lumiere Rewards account to the barista at a participating Lumiere store in order to redeem Points . You cannot redeem multiple Points redemption tiers within a single beverage order, and the maximum value for any individual redemption is $50 CAD. For example, you cannot redeem 50 Points for a hot brewed coffee and 25 Points for added syrup within a single beverage order.
If you redeem Points at a participating Lumiere store outside of Canada, the Points redemption tiers applicable in the country in which such store is located will apply and may differ from the Points redemption tiers in Canada that are set forth in these Terms of Use.
Additional Benefits of Lumiere Rewards
As a Lumiere Rewards member, you are eligible for the following additional benefits:
Birthday Reward. On your birthday (as indicated in your Lumiere Rewards account), you will receive one (1) complimentary handcrafted beverage OR one (1) complimentary food item OR one (1) complimentary ready-to-drink bottled beverage ("Birthday Reward").
Your Birthday Reward may be redeemed at participating Lumiere stores only and excludes: multi-serve food or beverage items (for example, a tray of pastries or a bulk coffee container); beverages that contain alcohol; merchandise and packaged coffee; and items available at designated Lumiere establishments
To qualify for your Birthday Reward, you must join Lumiere Rewards at least seven (7) days prior to your birthday, provide your birthday in your Lumiere Rewards account information, and make at least one Point-earning transaction prior to your birthday each year. Your Birthday Reward will be automatically added to your Lumiere Rewards account on your birthday and is valid only on that date. You must present a Lumiere Card registered to your Lumiere Rewards account to the barista at a participating Lumiere store in order to redeem your Birthday Reward. You will receive only one (1) Birthday Reward per year regardless of the number of Lumiere Cards that are registered to your Lumiere Rewards account.
If you provided Lumiere with a current, valid email address in your Lumiere Rewards account information and have opted to receive promotional emails, you will receive a reminder email from Lumiere approximately one (1) to three (3) days prior to your birthday indicating that your Birthday Reward is available to you. You also may receive a notification within the Lumiere mobile app. You can check to see if your Birthday Reward is available by accessing your Lumiere Rewards account in the Lumiere mobile app.
Free refill(s) of hot or iced brewed coffee and tea. To be eligible for free refill(s) of hot or iced brewed coffee or tea, you must use a Lumiere Card registered to your Lumiere Rewards account to purchase a hot or iced brewed coffee or tea and then present that same Lumiere Card for refills of such hot or iced brewed coffee or tea during the same store visit at participating Lumiere stores.
Early or extended access to certain promotions and offers. Lumiere may offer Lumiere Rewards members early or extended access to special menu items or discounts. You may take part in these offers by paying with a Lumiere Card registered to your Lumiere Rewards account at participating Lumiere stores.
Personalized offers and coupons. Special offers may be distributed by email, through the Lumiere mobile app (including via push notifications), or by physical mail. You may be required to opt-in and activate special offers via the Lumiere mobile app or via email. In order to receive and activate personalized special offers distributed via email, you must opt-in to receive promotional and marketing offers from Lumiere and you may be required to provide a valid email, telephone and physical address. Special offers may be customized based on your purchase behaviors and preferences, and may include periodic discounts on food, beverages and merchandise, or the opportunity to earn Bonus Points. Special offers may have certain restrictions, including expiration dates and short, time-limited redemption periods. Special offers are personal to you and cannot be shared, copied or transferred. You may be required to present or pay with a Lumiere Card registered to your Lumiere Rewards account in order to redeem special offers. Read each offer carefully for specific details, expiration dates, limitations and restrictions, and to learn whether Bonus Points will be awarded to your Lumiere Rewards account.
Double-Points Day. As a Lumiere Rewards member, you are eligible for one (1) Double-Points Day each calendar month beginning no later than five (5) weeks after you have joined Lumiere Rewards. Lumiere will notify you of your designated Double-Points Day each month, which may vary from month to month and will be personalized and selected by Lumiere for you. You must download the Lumiere mobile app OR opt-in to receive promotional and marketing emails from Lumiere in order to receive notice of your designated Double-Points Day. You also may be required to "activate" your Double-Points Day each month by clicking within the notification email or the notification within the Lumiere mobile app. On your designated Double-Points Day, the number of Points you earn when you use a Lumiere Card registered to your Lumiere Rewards account at participating Lumiere stores will be multiplied by two (2). Lumiere reserves the right to exclude certain products and merchandise from Double-Points Day eligibility and to modify the Double-Points Day benefit.
Lumiere reserves the right to change the number and type of additional benefits offered to members of Lumiere Rewards in its sole discretion at any time.
Other Important Information You Should Know
These Terms of Use complement and incorporate by reference the Lumiere Card Terms and Conditions. In the event of any conflict between the Lumiere Card Terms and Conditions and these Terms of Use, the Lumiere Card Terms and Conditions control.
There are no participation or membership fees associated with Lumiere Rewards. Points accrued in connection with Lumiere Rewards are promotional, have no cash value, and cannot be redeemed for cash. In addition, your redemption of Points accrued in connection with Lumiere Rewards cannot be combined with any other offers or discounts that are applicable to the Rewards for which you are redeeming such Points , unless otherwise expressly indicated by Lumiere.
Your Points, Rewards, Lumiere Cards registered to your Lumiere Rewards account, and your Lumiere Rewards account are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. You may have only one (1) Lumiere Rewards account that is personal to you.
Lumiere reserves the right to suspend any Lumiere Card registered to your Lumiere Rewards account and/or terminate your Lumiere Rewards account and/or your participation in Lumiere Rewards if Lumiere determines that you have violated these Terms of Use or that the use of your Lumiere Rewards account is unauthorized, deceptive, fraudulent or otherwise unlawful. Lumiere may suspend, cancel or combine Lumiere Rewards accounts that appear to be duplicative. In the event that your participation in Lumiere Rewards is terminated, all accrued Points in your Lumiere Rewards account are void.
Any Lumiere Card or Lumiere Rewards account that has been inactive for two (2) consecutive years will be rendered inactive and unregistered. Inactivity is defined as no Points earned or redeemed during such two (2) consecutive year period. In the event that your Lumiere Card or Lumiere Rewards account is unregistered or rendered inactive, all accrued Points in your Lumiere Rewards account are lost.
Lumiere reserves the right to change, modify, discontinue or cancel Lumiere Rewards or any part of Lumiere Rewards at any time and in its sole discretion, without notice to you.
Severability
If any provision or part of a provision of these Terms of Use is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.
